 韓：早知無蜜月期 用人會更謹慎

準高雄市長韓國瑜小內閣原民會主委人選餘波盪漾，宅神朱學恆抨擊「還沒上任就結束蜜月期」，館長陳之漢也嗆「下一步全面反你」。韓國瑜4日回應，「勝選後就知道沒有蜜月期，大家對我們用人標準很高，用人會更小心謹慎。」

林國權人事案引爆2位網路聲量極高、選前力挺韓國瑜的宅神與館長怒火，宅神朱學恆在粉絲專頁說「我這人最恨詐騙集團」、「還沒上任就結束蜜月期，正好代表這世界上沒有任何不可以挑戰的權威」。

館長陳之漢也抨擊，偏偏選一個有詐欺前科的，還沒給全民一個交代，就起用這麼一個人當內閣，「下一步全面反你！」

韓說，謝謝朱學恆指教，館長的直播還未看，不過，他很清楚大家對未來高市府用人標準很高，之後用人必須更小心更謹慎。

韓國瑜也還原徵詢林國權過程，當時專注於是否專業與熱情，未問到有無前科及官司問題，會記取教訓，徵詢閣員時，還要多問一句是否有法律等問題，廉潔內閣是他追求的唯一目標。

對於時力立委黃國昌炮轟楊秋興前機要及楊秋興是否會擔任副市長，韓國瑜說，不清楚楊秋興前機要的事情，副市長及其他內閣成員的人事案，下周會陸續公布。

韓國瑜也重申，人事一切以他公布的為準，對於大老就是楊秋興的說法，他不曉得，楊秋興有建議人選，但採不採納在於他。

韓國瑜強調，勝選後就知道沒有蜜月期，已經開始拚經濟，收到新加坡企業想瞭解高雄農漁特產品，就立即委託議員陳麗娜與農會系統組成小組前往接觸，目標是第一階把蔬果銷售出去，第二階段就是漁產品。

他說，市府更會大力推動農漁特產品賣出去，不容許發生中間剝削事情，即生產者到合作社等平台後就直接到買方端，確保利益回饋到農漁民。同時，也要保障消費者權益，不能讓價格居高不下。

 證據不足 環署撤銷彰化縣府罰台化12億不法利得

去年彰化縣府對台化裁處12億4千4百萬元不法利得，9日環保署訴願審議委員會決議撤銷彰化縣政府的行政處分。對此結果，彰化縣環保局局長江培根表示「無法理解」，台化公司副總洪福源則表示感謝環保署、訴願委員公平審議，並希望此案到此落幕結束。 台化廠區。照片來源：公共電視「我們的島」

台化與彰化縣府這一波鬥法，其中共提了4次訴願，台化贏了3次，包括前兩次的停工與這次的不法利得。目前台化處於停工狀態，是因為展延許可證仍處於「審查中」，彰化縣以遲遲未做出決定是否展延來反制。

彰化縣府以2016年採樣發現台化公司所使用的生煤成分不符環評承諾，因此提出要追討台化從2008年1月至2016年9月之間8年9個月賣電所得為不法利得，提出12億4千4百萬元的裁處，這個裁處可說是史上最高，不過，在環署訴願會的眼中，卻因為證據不足而遭撤銷。

訴願會執行秘書蘇中光解釋，彰化縣府在2016年9月29日對台化進行生煤抽檢，發現的確不符環說書承諾「總水分10%以下、固有水分2.6%、揮發分31.2%、固定碳54.3%」，並在同年12月裁處開罰30萬元，當時台化為此提出訴願，而彰化縣長魏明谷卻喊出要追討2008年1月至2016年9月之間的12億，因此雖然這30萬的訴願是台化敗訴，但彰縣府也因為一罪不能兩罰的原則，而自行撤銷這條裁處。

彰化縣政府指台化公司該8年9月間使用生煤、石油焦不符環說書承諾，因此這段期間持續燃燒品質不符標準生煤而獲取不法鉅額利得，因此提出12億4千4百萬元的裁處。不過，蘇中光表示，訴願會以其有認定事實錯誤、未盡舉證調查責任及處分理由不備等違誤，因此11位委員無異議決議撤銷彰縣府的裁罰。

訴願會指出，雖然台化使用了與環說書內容成分不同的生煤，但彰化縣並未提出這些生煤使用後的確造成空污排放，只以台化公司所自行申報的生煤樣品成分分析資料就來作為裁處不法利得的證據，是沒有盡到舉證責任，也不符合環評法的立法目的與宗旨。

蘇中光表示，即便是台化歷年交給彰縣府的生煤成分證明，也並非每一批都不符環說書內容，因此，彰化縣政府主張台化從2008年1月至2016年9月之間8年9個月持續違規也站不住腳，行政罰法所定3年的裁處權時效也因此已經消滅。

再者，訴願會也認為，彰縣府對台化不法利得的計算有瑕疵，雖然彰縣府想比照花蓮和平電廠超量發電案為例，但訴願會認為彰縣府的計算並沒有扣除台化的營運成本、淨利、停機歲修以及曾經購買符合環說書內容的生煤金額，且台化在這段期間的發電量並沒有超過環評承諾，因此金額還有待釐清。

消息傳出後，彰化縣環保局局長江培根面對對台化的裁處又遭撤銷，初步回應表示「無法理解」，但也因為還沒有收到環署訴願會的正式說明，因此無法多做回應，表示縣府收到後將會再研究，也尚未決定是否如之前的展延許可爭議一樣，遭撤銷後又捲土重來。而台化公司副總洪福源則表示感謝環保署、訴願委員公平審議，並希望此案到此落幕結束，也同樣不願多談。
